1. Purpose
This policy outlines the responsibilities and liabilities of renters and authorized drivers in the event of any traffic violations committed during the rental period of any vehicle booked through www.riderentals.co. It aims to ensure legal compliance, transparency, and accountability.
2. Definition of Traffic Violation
Traffic violations include, but are not limited to:
- Speeding
- Illegal parking
- Running red lights
- Driving without a seatbelt
- Use of mobile phone while driving
- Driving under the influence (DUI)
- Reckless or negligent driving
- Toll and road user charge evasion
- Any other offense under Kenya's Traffic Act or relevant local laws
3. Renter Responsibilities
- Full Liability: The renter is fully responsible for any traffic violation that occurs during the rental period.
- Notification: Renters must notify www.riderentals.co immediately if they are issued a traffic citation or stopped for a violation.
- Payment of Fines: All traffic violation fines, penalties, or legal fees incurred during the rental period must be paid by the renter.
- Administrative Fee: www.riderentals.co reserves the right to charge an administrative fee of Kes 5,000 for each traffic violation to cover processing costs.
- Toll Fees: Renters are responsible for all tolls incurred, and failure to pay may result in penalties.
4. Handling of Violations
- If www.riderentals.co receives a violation notice from authorities after the rental period, the renter's details (as per the rental agreement) may be shared with the relevant enforcement agency.
- The renter's payment method may be charged for the fine plus the applicable administrative fee without further notice.
- For cases involving vehicle impoundment, the renter is liable for all related costs including towing, storage, and legal fees.
5. Disputes
If a renter believes a traffic violation has been issued in error, they must:
- Notify www.riderentals.co in writing within 48 hours of receiving the notice.
- Pursue the dispute directly with the relevant authorities.
Note: Payment of the fine or penalties is still required unless officially waived by the authorities.
6. Repeat Offenders
Repeated violations may result in:
- Suspension or termination of rental privileges
- Blacklisting from the platform
- Legal action where necessary
